Tampa Training Ground TERMS & CONDITIONS
Terms and Conditions applicable to the Tampa Training Ground LLC (“TTG”), located at 6621 Memorial Hwy, Tampa, FL 33615, and any party present on-site deemed to be a “Participant” (For the avoidance of doubt this includes any non-trespassing party whether a parent, guardian, youth, adult trainee, player, or guest actively participating in and/or watching TTG activities).
Expectations
The following are designed to ensure a safe and professional environment for all Participants. Violation of these rules may result in the suspension or termination participation rights.
1. ATTIRE Proper athletic footwear and clothing must be worn at all times. Open-toed shoes, sandals, or working out shirtless are strictly prohibited. Shin guards are required for all soccer activities.
2. PERSONAL CONDUCT Profanity, harassment, or intimidating behavior toward staff or other Participants will result in immediate expulsion and potential termination.
3. PHOTOGRAPHY/VIDEO Out of respect for privacy, tripod use and filming other Participants without consent are prohibited. By entering TTG property, you grant TTG the right to film, photograph, and record Participant name and likeness for advertising, promotion, and other lawful purposes, without compensation to you. You agree to release TTG from any liability relating to the use of your image or likeness, including claims regarding privacy or right of publicity.
4. SAFETY Unless otherwise agreed, please do not move or handle any furniture, equipment, or fixtures without the assistance of a TTG staff member.
5. DROP-OFF TTG is a safe, fun place for kids and adults to enjoy and thrive within the soccer world. We allow for drop-off and pick-up for training up to a half hour before and after for Participants under 10 years old, one hour before and after for those 10-12 years old, and up to two hours before and after for 13-17 years old, all subject to TTG’s opening and closing times. Note if adult supervision is on-site, Participants may remain and participate in the TTG’s pick-up activities as long as the TTG is open.
6. PARENT AND GUARDIAN PLEDGE Team sports are one of the best ways to help children develop physically and emotionally. Unfortunately, youth athletes will quit organized sports earlier than they otherwise would because of too much external pressure and competition. We are committed to character and ability building. All we ask is that you pledge your support and encourage your youth athletes to have fun and commit to positive sportsmanship alongside the TTG team.
WAIVER, RELEASE, AND ASSUMPTION OF RISK
BY SIGNING THIS DOCUMENT, YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
1. Assumption of Risk: Participants understand that there are risks involved with the activities of TTG, that include and are not limited to recreational to competitive soccer activities, camps, clinics, and matches, and any other activities affiliated with the TTG (“Activities”).
Participants, and as the parent or guardian with legal responsibility of a minor child, if applicable (Also referred to as “Participant”) that plans to participate in Activities, for valuable consideration given, the receipt and sufficiency of which is hereby acknowledged, do hereby acknowledge that their child will participate in these Activities. Participants hereby authorize TTG to act according to their reasonable judgment in any emergency requiring medical attention. Participants hereby waive and release TTG from all liability and agrees to accept all medical expenses incurred. Participants know of no physical or mental problem that will affect their or their ability to safely participate in these Activities. Participants certify that themselves and their minor Participants are in good health and may participate in strenuous physical activities. Participants certify that there are no physical limitations to their participation in Activities. Permission is granted for minor Participants to receive emergency medical treatment if needed. Participants hereby releases and forever discharges TTG and all their agents, employees and affiliated entities from any and all liability, claims, demands, and cause of action for personal injury or death, property damage, and/or other loss suffered by their Participant in connection with his/her participation in Activities.
2. Release and Indemnification: Participants acknowledge and accept that this release and indemnification is intended to be binding on the family, estate, heirs, executors, administrators and assigns of the Participant. Participants further acknowledge and accept that this release and indemnification is intended to be as broad and inclusive as permitted by the laws of Florida and agrees that if any portion of this release and indemnification is invalid, the remainder will continue to be in full force and effect. Participants agree that this release and indemnification binds the minor Participants and their guardian Participants to all of its terms. Participants hereby grant permission to TTG and its legal representatives, assigns, and those acting on its behalf, to use any picture, video or audio recording of Participants taken in connection with the Activities for all manner of advertising, trade, promotion, exhibition, or any other lawful purpose related to youth soccer whatsoever and in any form or medium.
Participants hereby release TTG and its owners, officers, employees, agents, coaches and players (the “Release Parties”) from all liability or responsibility for any claims, demands, causes of action, damage, causes of action, or legal action for personal injury, property damage, or wrongful death, whether caused by ordinary negligence of the Release Parties or otherwise, while the Participants are on the premises.
3. Florida Specifics: This agreement is intended to be as broad and inclusive as permitted by the laws of the State of Florida. If any portion is held invalid, the remainder shall continue in full legal force.
4. NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN, IF APPLICABLE:
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF TAMPA TRAINING GROUND LLC USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM TAMPA TRAINING GROUND LLC IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO AGREE TO THESE TERMS, AND TAMPA TRAINING GROUND LLC HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT AGREE.
